When technology advances faster than the law

Although the legal framework for business operations in Vietnam is relatively comprehensive, technology often advances faster than the law. As a result, newer and higher-risk sectors typically lack detailed and specific legal guidance for implementation. Consequently, businesses often rely on the principle of “what is not prohibited by law is permitted” when entering these emerging fields.

However, in practice, even if something is not explicitly prohibited, there may be numerous legal conditions that must be met for a business to operate lawfully—conditions that many businesses cannot fully satisfy. This may lead to potential legal risks arising from differences in interpretation or from the evolving nature of the legal framework itself.

In addition, variations in the application of regulations across different localities or administrative levels may create certain uncertainties for enterprises, particularly when dealing with new business models or technology-related activities. In some cases, the coordination among competent authorities and the process of issuing guiding documents may take time, which can affect the pace of implementation and investment planning.

Therefore, businesses need to have a thorough understanding and apply a principled approach of “possibly implementing in accordance with regulations” to minimize legal risks. At the same time, continued efforts to enhance inter-agency coordination, ensure clarity in administrative guidance, and keep the legal system updated with technological developments will contribute to a more predictable and supportive business environment.
