Recommendation about education activities
HNLaw & Partners recommends that foreign investors planning to establish a foreign language training center in Vietnam should carefully review and comply with relevant regulations on education and investment to ensure lawful and efficient operation.
Recommended Conditions for Establishment
HNLaw advises maintaining an investment scale of around 20 million VND per learner, or approximately 14 million VND per learner if using leased premises.
Facilities should include well-equipped classrooms, teaching tools, and learning areas of at least 2.5 m² per learner.
Administrative spaces such as offices, libraries, and functional rooms are highly recommended for proper management.
Training programs may be designed as short-term or specialized language courses.
HNLaw recommends hiring teachers with appropriate college-level qualifications and at least five years of relevant experience for foreign lecturers.
An optimal student–teacher ratio would be no more than 25 to 1, ensuring effective teaching quality.
Recommended Licensing Procedures
Investors are encouraged to first obtain an Investment Registration Certificate from the Department of Planning and Investment, supported by a clear project proposal, proof of financial capacity, and valid premises documentation.
Subsequently, establish the enterprise under the approved investment plan.
To operate, the investor should submit an application for educational establishment approval to the Department of Education and Training, including documents on facilities, teaching programs, and staffing plans.
Upon approval, the investor should apply for the Certificate of Educational Operation within 24 months and formally announce the commencement of operation in five consecutive newspapers within 20 working days.
