Law on entry exit for foreigners

Amended Law to a number of articles of law on entry, exit, transit and residence of foreigners in Vietnam 2019 is valid from 1^st July, 2020 with the following new points:

1.Addition of regulations about issuance of electronic visas of foreigners as follows

Item 9, Article 1 of Amended Law to a number of articles of law on entry, exit, transit and residence of foreigners in Vietnam 2019 adds regulations about issuance of electronic visas of foreigners as follows:

Step 1. Login to information site to decrare

Declare information in application for issuance of electronic visas and upload photo and passport record in information site for issuance of electronic visas.

Step 2. Submit fees for visa issuance

Submit fees for visa issuance to accounts specified in information site for issuance of electronic visas after receiving code of electronic profiles of immigration authorities.

Step 3. Request Process

Immigration authorities shall consider, process and respond to applicants at the information site for issuance of electronic visas within 3 working days from the date on which all information and fees for visa issuance have been received.

Step 4. Result Receival

Foreigners issued with electronic visas shall use code of electronic profiles to check and print results of issuance of electronic visas at information site for issuance of electronic visas.

2. Cases that a visa of an individual be repurposed

In accordance with item 2, Article 1 of Amended Law to a number of articles of law on entry, exit, transit and residence of foreigners in Vietnam 2019, cases that a visa of an individuals is repurposed includes:

– He/she presents document proving to be an investor or a representative for foreign organization investing in Vietnam as per the law of Vietnam;

– He/she presents document proving his/her relationship with person inviting or sponsoring in terms of parents, spouse, children;

– He/she is invited or sponsoring by agencies or organizations and presents work permit or confirmation of eligibility for work permit exemption according to labor laws.

– He/she makes entry by electronic visa and presents work permit or confirmation of eligibility for work permit exemption according to labor laws.

This is a regulation suitable with actual situations, thus creating favors for foreigners with succeeding stay in Vietnam without loss of time and fees to make exit procedure then entry procedures. However, in order to repurpose visa, a foreigner must belong to the above mentioned circumstances with proved documents.

3. Amendments to conditions for exit and entry

* Amendments to entry conditions

Accordance with item 11, Article 1 of Law on admendments to a number of articles of law on entry, exit, transit and residence of foreigners in Vietnam, foreigners is permitted for entry in Vietnam with following conditions:

– He or she possesses a passport or documents enabling international travel, except for cases of visa-free entry as specified in this Law.

– He or she does not fall into categories of entry suspension.

Note: A foreigner making entry on electronic visas must fully satisfy all conditions specified as above mentioned and make entry via international border checkpoints decided by the Government.

* Amendments to exit conditions:

A foreigner shall be permitted for exit if he/she:

– possesses a passport or documents enabling international travel; and;

-temporary residence certificate, temporary resident card or permanent residence card of his/hers is still valid;

– does not fall into categories of exit suspension.

Note: A foreigner making exit on electronic visas must fully satisfy all conditions specified as above mentioned and make exit via international border checkpoints decided by the Government.
