In practice, the implementation of investment projects is often significantly affected by objective factors, including circumstances considered force majeure or beyond the investor’s control.

As a natural consequence, the investor is compelled to restructure capital sources and adjust the project’s scale, timeline, or implementation approach in order to ensure feasibility.

Accordingly, the preparation of a detailed explanatory statement is a decisive requirement, aimed at clarifying the nature of the arising obstacles, demonstrating their objective causes, and evidencing the investor’s good faith and efforts in addressing such issues.
On that basis, the investor should propose specific recommendations, such as adjusting the capital contribution schedule, extending the project implementation timeline, or modifying the investor structure in line with actual conditions.
A well-structured explanatory statement, supported by sound reasoning and adequate documentary evidence, will serve as an important basis for competent authorities to consider approving the proposed adjustments, thereby resolving difficulties and enabling the project to continue its stable implementation.
