Conditional business approach
Although the legal framework for business operations in Vietnam is relatively comprehensive, technology often advances faster than the law. As a result, newer and higher-risk sectors typically lack detailed and specific legal guidance for implementation. Consequently, businesses often rely on the principle of “what is not prohibited by law is permitted” when entering these emerging fields.
However, in practice, even if something is not explicitly prohibited, there may be numerous legal conditions that must be met for a business to operate lawfully—conditions that many businesses cannot fulfill. This leads to significant legal risks due to gaps in the legal framework.
Therefore, businesses need to have a thorough understanding and apply a principled approach of “possibly implementing in accordance with regulations” to minimize legal risks.
