CHEMICAL IMPORTS
A chemical import license constitutes a critical legal component within the compliance framework of enterprises operating in the chemical sector. It not only legitimizes commercial activities but also serves to control risks related to safety, environmental protection, and chemical security.
Accordingly, prior to importation, enterprises are required to review and supplement their registered business lines to include activities related to the import and export of chemicals in their enterprise registration dossier.
At the same time, the screening and classification of intended imported chemicals play a key role in determining the legal nature of each substance, including: ordinary chemicals, conditional business chemicals, and chemicals subject to special control.
Such classification forms the basis for applying the appropriate legal requirements, thereby mitigating risks of customs clearance refusal or administrative penalties.
Based on the screening results, enterprises must fully satisfy the prescribed conditions, particularly for chemicals subject to conditional business requirements.
A dossier for obtaining a Certificate of Eligibility for Conditional Chemical Business typically includes:
- an application for the license;
- documents evidencing facilities and infrastructure conditions, such as a master layout plan of the chemical storage warehouse together with land use rights documents or storage service lease agreements
- completion acceptance records; documentation on approved chemical incident prevention and response plans or measures;
- professional qualifications of the person in charge of chemical safety;
- certificates of chemical safety training; and Safety Data Sheets (SDS) corresponding to the chemicals proposed for licensing.
The thorough and accurate preparation of the dossier not only expedites processing time but also demonstrates the enterprise’s compliance capacity in this high-risk sector.
