CHEMICAL CONSULTATION 

In the course of importing chemicals into Vietnam, failure to fully review legal conditions prior to customs clearance may expose enterprises to significant risks, including administrative penalties, business interruption, or even mandatory re-export of goods.

In practice, HNLaw once advised an enterprise importing chemicals for manufacturing purposes that had not yet completed the procedures for obtaining the Certificate of Eligibility for Chemical Trading as required under specialized chemical regulations.

During the customs clearance process, the competent authorities requested the enterprise to supplement legal documents related to the importation and trading of chemicals because the imported products fell under the category of conditional chemicals subject to regulatory control.

Immediately after taking over the matter, HNLaw conducted a comprehensive review of the imported chemical list, classified the legal nature of each chemical, and assessed the legal risks that the enterprise could potentially face.

At the same time, HNLaw advised the enterprise on chemical declaration obligations, import conditions, chemical trading requirements, as well as the legal framework applicable to the storage, transportation, and use of industrial chemicals in Vietnam.

In addition, HNLaw assisted the enterprise in preparing chemical declaration dossiers through the Vietnam National Single Window (VNSW), advised on completing the application for the Certificate of Eligibility for Chemical Trading, and coordinated with the competent authorities to resolve issues arising during the customs clearance process.
